By using CostaRicaClick's search engine, you agree to be bound by the following terms and conditions, which we may update without notice and encourage you to check back here at any time. To use the CostaRicaClick, you must be legally competent to enter a binding agreement.

Privacy Policy

The only personal information (PI) about you (that is, your name, e-mail or physical address, or telephone number) that the COSTARICACLICK receives is any (PI) you choose to include in the submission form if you submit a site for consideration for inclusion in the COSTARICACLICK. We use such (PI) only in connection with the provision of the COSTARICACLICK, and do not share your personal in with any outside companies.

When you use or access the COSTARICACLICK, we automatically receive and store certain information from your browser, including your IP address; your browser type; access date and time; the referring Web site address; the COSTARICACLICK page you requested; and in the case of a search, the specific search terms requested. We use this information for purposes of security, to learn more about how the COSTARICACLICK is used, and to improve the quality and usefulness of the COSTARICACLICK. The sites displayed as search results or linked to by CostaRicaClick Services are developed by people over whom CostaRicaClick exercises no control. The search results that appear from CostaRicaClick's indices are indexed by CostaRicaClick's software or by third parties that use the “Add Sites” option and CostaRicaClick cannot and do not screen the sites before including them in the indices from which such automated search results are gathered. A search using CostaRicaClick Services may produce search results and links to sites that some people find objectionable, inappropriate, or offensive. We cannot guarantee that a CostaRicaClick search will not locate unintended or objectionable content and assume no responsibility for the content of any site included in any search results or otherwise linked to by the CostaRicaClick Services.

Personal Use Only

The CostaRicaClick Services are made available for your personal, non-commercial or non-profitable use only. You may not use the CostaRicaClick Services to sell a product or service, or to increase traffic to your Web site for commercial reasons, such as advertising sales. You may not take the results from a CostaRicaClick search and reformat and display them, or mirror the CostaRicaClick home page or results pages on your Web site. You may not "meta-search" CostaRicaClick. If you want to make commercial use of the CostaRicaClick Services, you must enter into an agreement with CostaRicaClick to do so in advance. No Automated Querying

You may not send automated queries of any sort to CostaRicaClick's system without express permission in advance from CostaRicaClick. Note that "sending automated queries" includes, among other things:

• using any software which sends queries to CostaRicaClick to determine how a website or webpage "ranks" on CostaRicaClick for various queries;
• "meta-searching" CostaRicaClick; and
• performing "offline" searches on CostaRicaClick.

Please do not write to CostaRicaClick to request permission to "meta-search" CostaRicaClick for a research project, as such requests will not be granted.

Changes In Terms and Conditions and CostaRicaClick Search Service

We may modify or terminate our services from time to time, for any reason, and without notice, including the right to terminate with or without notice, without liability to you, any other user or any third party. We reserve the right to modify these Terms of Service from time to time without notice. Please review these Terms of Service from time to time so that you will be apprised of any changes.

CostaRicaClick disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed in the COSTARICACLICK SERVICES results. CostaRicaClick disclaims any responsibility for the deletion, failure to store, miss-delivery, or untimely delivery of any information or material. CostaRicaClick disclaims any responsibility for any harm resulting from downloading or accessing any information or material on the Internet through the CostaRicaClick Services.

THE COSTARICACLICK SERVICES, AND ALL MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN THE COSTARICACLICK SERVICES ARE PROVIDED WITH NO WARRANTIES WHATSOEVER. COSTARICACLICK AND ITS LICENSORS DISCLAIM, ANY WARRANTIES FOR ANY INFORMATION OR ADVICE OBTAINED THROUGH THE COSTARICACLICK SERVICES. COSTARICACLICK AND ITS LICENSORS DISCLAIM ANY WARRANTIES FOR SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE COSTARICACLICK SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED BY THE COSTARICACLICK SERVICES, AS WELL AS FOR ANY INFORMATION OR ADVICE RECEIVED THROUGH ANY LINKS PROVIDED IN THE COSTARICACLICK SERVICES.

Limitation of Liability

ARISING FROM ANY CLAIM RELATING TO THIS AGREEMENT OR THE SUBJECT MATTER HERE OF SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF COSTARICACLICK OR ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). THIS LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE COSTARICACLICK SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE COSTARICACLICK SERVICES, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE COSTARICACLICK SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE COSTARICACLICK SERVICES. THIS LIMITATION SHALL ALSO APPLY, WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA. SUCH LIMITATION SHALL FURTHER APPLY WITH RESPECT TO THE PERFORMANCE OR NON-PERFORMANCE OF THE COSTARICACLICK SERVICES OR ANY INFORMATION OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR RELATED IN ANY WAY TO, THE COSTARICACLICK SERVICES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING A FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.

Without limiting the foregoing, under no circumstances shall CostaRicaClick or its licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

SPECIAL ADMONITIONS FOR INTERNATIONAL USE

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from Costa Rica or the country in which you reside.

DEALINGS WITH ADVERTISERS

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that CostaRicaClick shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

Requests for Removal of Links

CostaRicaClick occasionally receives requests from people to remove links from its indices. Although CostaRicaClick reserves the right to address such requests individually, the general approach that CostaRicaClick takes reflects the following principles:

CostaRicaClick's indices consist of information that has been identified, indexed and compiled through an automated process with no advance review by human beings. Given the enormous volume of web site information added, deleted, and changed on a frequent basis, CostaRicaClick cannot and does not screen anything made available through its indices. For each web site reflected in CostaRicaClick's indices, if either (i) a site owner restricts access to his or her web site or (ii) a site is taken down from the web, then, upon receipt of a request by the site owner or a third party in the second instance, CostaRicaClick would consider on a case-by-case basis requests to remove the link to that site from its indices. However, if the operator of the site does not take steps to prevent it, the automatic facilities used to create the indices are likely to find that site and index it again in a relatively short amount of time.

Without CostaRicaClick's prior permission, you agree not to display or use in any manner, the CostaRicaClick Marks.

COPYRIGHTS and COPYRIGHT AGENTS

CostaRicaClick respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide CostaRicaClick's Copyright Agent the following information:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
2. a description of the copyrighted work or other intellectual property that you claim has been infringed;
3. a description of where the material that you claim is infringing is located on the site;
4. your address, telephone number, and email address;
5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
